Privacy Policy

1. INTRODUCTION

P1 Futures LLC ("P1 Futures," "we," "us," or "our") respects your privacy. This Privacy Policy explains what
personal information we collect, how we use and share it, how we protect it, and the rights and choices you have.
It applies to www.p1futures.com, our related applications, and the services we provide (the "Platform"), and to information we collect through email, text, and our official community channels where this Policy is referenced.
It does not apply to third-party websites, platforms, or services we do not control, even where we link to them.
Those are governed by their own privacy policies, and we identify the main ones in Section 6.
By using the Platform you acknowledge this Policy. Where we rely on your consent, we ask for it separately.

2. WHO WE ARE

P1 Futures LLC is a Delaware limited liability company operating from Texas. For all privacy matters we are the controller of your personal information, meaning we decide why and how it is processed.

3. INFORMATION WE COLLECT

We collect the following categories of personal information.

3.1 Information You Provide

- Account and identity: name, email address, postal address, phone number, date of birth, country of citizenship and residence, and username.
- Identity verification (KYC): government-issued photo identification, proof of address, and a facial image or liveness capture used to confirm your identity. See Section 4 on biometric information.
- Payment information: billing details and the payment method used. Full card numbers are handled by our payment processors and are not stored by us.
- Payout information: the details required to pay you, and the tax forms you provide, including IRS Form W-9 or Form W-8BEN.
- Trading and account activity: your evaluation and funded account performance, trading records, and
account history.
- Communications: the content of messages you send us, support tickets, survey responses, and correspondence.
- Community content: anything you post in our Discord, on our social channels, on leaderboards, or in other public areas of the Platform.
- Affiliate information: where you are an affiliate, the information needed to administer the affiliate program and pay commissions.

3.2 Information We Collect Automatically

As you use the Platform we collect:
- Device and connection data: IP address, device type, operating system, browser type, and language.
- Usage data: pages viewed, links clicked, time on page, referring pages, and how you navigate the Platform.
- Location data: approximate location derived from your IP address, used among other things to assess eligibility under our Terms.
- Cookies and similar technologies: as described in Section 7.

3.3 Information From Third Parties

- Verification and screening providers, who return the results of identity verification and sanctions and watchlist screening.
- Payment and payout providers, who confirm the status of your payments and payouts.
- Advertising and analytics partners, who help us measure and attribute marketing, including our affiliate and influencer activity.
- Our affiliates and business partners, where you reach us through them.

3.4 Sensitive Information

Some of what we collect is treated as sensitive under applicable law, including government identification
numbers, biometric information, financial account information, and precise or inferred location. We collect
sensitive information only where needed to operate the Platform, verify identity, meet legal obligations, and pay you, and we apply the protections described in this Policy. We do not sell sensitive personal information.

4. BIOMETRIC INFORMATION

To verify that you are who you say you are, our identity verification process, performed by a third-party provider, may capture a facial image and perform a liveness check and facial comparison against your
identification document. This may involve biometric identifiers or biometric information under laws including the Illinois Biometric Information Privacy Act and the Texas Capture or Use of Biometric Identifier Act.

Purpose. We use biometric information solely to verify your identity, prevent fraud and duplicate accounts, and meet our compliance obligations. We do not use it for any other purpose.
Consent. Where consent is required for the collection of biometric information, it is obtained through the verification process at the point of capture, before any biometric information is collected.
Disclosure. We do not sell, lease, or trade biometric information. We share it only with the verification provider that performs the check and as required by law.
Retention. Biometric information is retained only as long as needed for the verification purpose, or as required by law, and is then deleted in line with our retention schedule and the provider's practices. See Section 10.

5. HOW WE USE YOUR INFORMATION

We use personal information to:
- Create and administer your account and provide the Platform
- Process purchases, evaluations, funded accounts, and payouts
- Verify your identity and screen against sanctions and watchlists
- Detect, investigate, and prevent fraud, abuse, and prohibited conduct
- Enforce our Terms and other agreements
- Administer the affiliate and influencer programs
- Respond to your requests and provide support
- Send you service messages about your account, purchases, payouts, and changes to our terms or policies
- Send you marketing communications, where permitted, which you can opt out of at any time
- Measure and improve the Platform and our marketing, including attribution of affiliate and influencer referrals
- Comply with legal, tax, and regulatory obligations
- Establish, exercise, or defend legal claims
Where the law requires a legal basis (see Section 11), we rely on performance of our contract with you, our legitimate interests in operating and securing the Platform, your consent where we ask for it, and compliance with our legal obligations.

6. HOW WE SHARE YOUR INFORMATION

We do not sell your personal information for money. We share it in the following ways.

6.1 Service Providers

- Payment processing: our card and alternative payment processors
- Payouts: our payout provider, which onboards you, verifies your identity, and pays you
- Identity verification and screening: our KYC and sanctions-screening providers
- CRM, email, and messaging: the platforms that run our funnels, email, and SMS
- Analytics and advertising: the providers described in Section 7
- Hosting and infrastructure: the trading platform, data providers, and cloud services that run the Platform
Several of these providers operate outside the United States, including in the European Union. See Section 9 on international transfers.

6.2 Legal and Protective Disclosures

We may disclose personal information to comply with a law, regulation, court order, or government or regulatory request, to enforce our agreements, and to protect the rights, property, and safety of P1 Futures,
our traders, and others, including for fraud prevention.

6.3 Business Transfers

If we are involved in a merger, acquisition, financing, reorganization, or sale of all or part of our assets, personal information may be transferred as part of that transaction. We will require the recipient to honor this Policy or notify you of any material change.

6.4 Affiliates and Corporate Group

We may share personal information within our corporate group to operate the Platform consistently.

6.5 Aggregated and De-identified Data

We may share aggregated or de-identified information that does not identify you, without restriction. We will not attempt to re-identify it.

6.6 Your Direction

We share information as you direct, including content you choose to post publicly on the Platform or in our
community channels.

7. COOKIES, ANALYTICS, AND ADVERTISING

7.1 What We Use

We and our partners use cookies, web beacons, pixels, and similar technologies to run the Platform, remember your preferences, measure usage, and support marketing. These include:
- Essential technologies that make the Platform work, including login and security. These cannot be switched off.
- Analytics that help us understand how the Platform is used.
- Advertising and attribution technologies that measure our marketing and support interest-based advertising, including attribution of affiliate and influencer referrals.

7.2 Third-Party Tools

The Platform uses the following third-party technologies:
- Google Analytics (Google LLC) for usage analytics
- Meta Pixel (Meta Platforms, Inc.) for advertising measurement and attribution
- TikTok Pixel (TikTok) for advertising measurement and attribution
- GoHighLevel for CRM, funnels, forms, email, and SMS tracking
These providers may set their own cookies and collect information about your activity over time and across sites. We do not control their technologies. Consult their privacy policies for details.

7.3 Your Choices

You have the following choices about cookies and tracking:
- Browser controls. You can set your browser to refuse or alert you to cookies. Some parts of the Platform may not work properly if you do.
- Advertising opt-outs. You may opt out of interest-based advertising from participating companies through the Network Advertising Initiative and the Digital Advertising Alliance. Where required by applicable law, we honor recognized universal opt-out preference signals for the sale of personal information and targeted advertising.

8. YOUR PRIVACY RIGHTS

Depending on where you live, you may have some or all of the following rights over your personal information:
- Access and confirmation of whether we process your information
- Correction of inaccurate information
- Deletion of your information
- Portability, to receive a copy in a portable format
- Opt out of the sale of personal information, targeted advertising, and profiling that produces legal or
similarly significant effects
- Limit the use of sensitive information, or withdraw consent
- Non-discrimination for exercising your rights

8.1 How to Exercise Your Rights

Email trade@p1futures.com. We will verify your identity before acting, which may require confirming information we already hold. You may use an authorized agent where the law allows.

We respond within the time the applicable law requires, generally within 45 days, and will tell you if we need an extension. There is no charge unless your request is excessive or repetitive.

8.2 Appeals

If we decline your request, you may appeal by replying to our decision. If we deny your appeal and you are in a state that provides it, you may contact your state Attorney General.

8.3 Account Information

You can review and update much of your account information by logging in. Deleting certain information may require closing your account. Some information is retained as described in Section 10.

9. STATE AND REGIONAL DISCLOSURES

9.1 Texas Residents

Under the Texas Data Privacy and Security Act, Texas residents have the rights listed in Section 8. We do not sell personal data for money. To the extent our use of advertising technologies is treated as targeted
advertising or a "sale" under the Act, you may opt out through the mechanisms in Section 7.3. We do not sell sensitive personal data. To exercise your rights or appeal a decision, contact trade@p1futures.com.

9.2 California Residents

Under the California Consumer Privacy Act, as amended, California residents have the rights listed in Section 8, including the right to know, delete, correct, and opt out of the sale or sharing of personal information and of targeted advertising. We do not sell personal information for money. Where required by applicable law, we honor recognized opt-out preference signals. We do not use or disclose sensitive personal information for purposes that would require a right to limit under the Act, beyond what is needed to provide the Platform,
verify identity, and meet legal obligations. California residents may exercise rights through an authorized agent.

9.3 Other US States

Residents of other states with comprehensive privacy laws, including Colorado, Connecticut, Virginia, Oregon, Montana, and others as they take effect, have rights similar to those in Section 8. Contact trade@p1futures.com to exercise them.

9.4 Nevada Residents

Nevada residents may opt out of the sale of certain personal information by emailing trade@p1futures.com.

9.5 European Union, EEA, and United Kingdom

Where the EU or UK General Data Protection Regulation applies, you have rights to access, rectification,
erasure, restriction, portability, objection, and to withdraw consent, and the right to lodge a complaint with your supervisory authority.

Legal bases. We process your information to perform our contract with you, for our legitimate interests in operating and securing the Platform and preventing fraud, to comply with legal obligations, and on the basis of your consent where we ask for it.

Transfers. Your information may be processed in the United States and other countries. Where we transfer
information out of the EEA or UK, we rely on appropriate safeguards, including the European Commission's Standard Contractual Clauses, or a recognized adequacy mechanism.

10. DATA RETENTION

We keep personal information for as long as needed to provide the Platform and for the purposes described in this Policy, and then for as long as required to meet legal, tax, accounting, anti-money-laundering, and dispute-resolution obligations.

Records connected to identity verification, payments, and payouts are generally retained for at least five years after the end of our relationship, consistent with financial-recordkeeping practice. Biometric information is retained only as long as needed for verification and then deleted, as described in Section 4. When information is no longer needed, we delete or de-identify it.

11. HOW WE PROTECT YOUR INFORMATION

We use administrative, technical, and physical safeguards designed to protect personal information, and we require our service providers to do the same. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential and for what you share in public areas of the Platform.

Where we are legally required to notify you of a data breach, we will do so.

12. CHILDREN

The Platform is not intended for anyone under 18, and we do not knowingly collect information from anyone under 18. If we learn we have collected information from a person under 18, we will delete it. If you believe a minor has provided us information, contact trade@p1futures.com.

13. THIRD-PARTY LINKS

The Platform links to third-party sites and services, including our payment, payout, trading, and community providers. We are not responsible for their privacy practices. Review their policies before providing
information.

14. CHANGES TO THIS POLICY

We may update this Policy. We will post the updated version with a new "Last Updated" date, and for material changes we will provide additional notice, such as a notice on the Platform or by email. Your continued use after an update means you accept it. Keep your email address current so you receive notices.
